These Terms of Service ("Terms") govern your access to and use of the FoodiePals mobile application and any related services (together, the "Service").
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
FoodiePals helps you discover restaurants through recommendations from people in your social network. The Service lets you:
Restaurant information (such as opening hours, addresses, menus, and ratings) is provided in part by third parties, including Google Places. We do not guarantee that this information is accurate, complete, or up to date.
We do not verify or endorse recommendations made by users. Recommendations reflect personal opinions. You must not rely on User Content as a basis for decisions without independent verification.
You must be at least 16 years old to use the Service. By using FoodiePals you confirm that you meet this requirement.
You can sign in using Apple, Google, or your email address. You are responsible for keeping your sign-in credentials safe and for all activity under your account. Please notify us immediately at contact@foodiepals.ch if you suspect unauthorised access.
Each person may only register one account. We reserve the right to remove duplicate, fraudulent, or abusive accounts.
You must provide accurate information and keep it up to date.
User Content is provided by users and reflects their personal opinions only. FoodiePals does not adopt, endorse, verify, or assume responsibility for any User Content. We do not guarantee the accuracy, completeness, or reliability of user statements.
User Content must not be interpreted as factual or verified information.
You may post recommendations, responses, photos, comments, and other content ("User Content"). You retain ownership of your User Content.
By posting User Content, you grant FoodiePals a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, copy, display, distribute, and use that content for the purpose of operating, providing, improving, and developing the Service.
This licence ends when you delete your User Content or your account, except where:
You are solely responsible for your User Content.
You agree to indemnify and hold FoodiePals harmless from any claims, damages, losses, and expenses arising out of or in connection with:
This applies only where you are at fault.
You agree that your User Content will not:
We may review and take action where appropriate. Nothing in these Terms creates an obligation to monitor content.
If you believe that User Content is unlawful, inaccurate, or infringes your rights (including defamation or misleading statements), you may report it to us.
Upon receiving a notice, we will assess the content and take appropriate action without undue delay where required by law.

If you enable contact matching, FoodiePals processes your contact data to help you find people you know on the Service.
We do not store your full contact list — only the hashed data necessary for matching, as described in our Privacy Policy.
You confirm that you are permitted to share this information under applicable law.

When you use the Service, data may be transmitted to these providers. Their use of your data is governed by their own terms and privacy policies. Where required by applicable law, processing by such providers is based on your consent.

FoodiePals, its logo, and the Service (excluding User Content and third-party content) are owned by us and protected by applicable laws.
You may not use our branding or intellectual property without prior written consent.
Some content within the Service may be sponsored or promoted by third parties (e.g. restaurants). Such content will be clearly identified as sponsored or featured. Sponsored content may influence the visibility or ranking of restaurants within the Service.
The presence of sponsored content does not constitute a recommendation or endorsement by FoodiePals.
All restaurant information and User Content are provided "as is" and may be inaccurate, incomplete, or outdated.
User recommendations, ratings, and other content are subjective opinions and do not constitute verified statements of fact.
FoodiePals does not guarantee the safety, quality, hygiene, suitability, or availability of any restaurant.
User ratings, aggregated scores, or overall impressions may create a general perception of a restaurant. However, such impressions are based solely on individual opinions and must not be interpreted as accurate, representative, or reliable indicators of actual conditions, including food safety.
The Service is not intended to be relied upon for important, health-related, or time-critical decisions, including but not limited to events, celebrations, business purposes, or dietary or medical considerations.
You are solely responsible for independently verifying whether a restaurant meets your expectations and requirements, including safety, hygiene, allergens, and availability.
FoodiePals is not responsible for your experience at any restaurant or for any consequences resulting from reliance on User Content.
If we become aware of content indicating potential health or safety risks, we may review, restrict, or remove such content.
We may add, modify, or remove features of the Service at any time.
This includes features, functionality, or user data representations (such as saved content, recommendations, or social interactions).
Some features may be experimental and may change or be discontinued without notice.
We may also suspend or discontinue the Service entirely. Where possible, we will provide reasonable notice.
We do not guarantee that any content, including User Content or saved items, will remain available or unchanged.
We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free, or that it will be available in all locations.
You may stop using the Service and delete your account at any time.
We may suspend or terminate your access if:
Certain data may be retained after termination where required for legal, security, or fraud prevention purposes.
Content you have shared may remain visible to other users (e.g. within conversations), but will no longer be associated with your active profile.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind.

Nothing in these Terms limits mandatory consumer rights under EU or German law.
To the maximum extent permitted by law, FoodiePals is liable only for damages caused by intent or gross negligence.
For simple negligence, liability is limited to breaches of essential contractual obligations (Kardinalpflichten) and to foreseeable, typical damages.

These Terms are governed by German law.
If you are a consumer in the EU, you also benefit from mandatory protections of your country of residence.
For non-consumers, the exclusive place of jurisdiction is Munich, Germany.

We are not obliged or willing to participate in consumer arbitration proceedings.
If you use the Service on an Apple device, the following terms apply:
Apple Inc. is not a party to these Terms and is not responsible for the Service or its content.
FoodiePals, not Apple, is solely responsible for providing maintenance and support for the Service.
Apple has no obligation to provide maintenance or support services.
To the extent permitted by law, Apple shall have no liability for any claims relating to the Service, including but not limited to product liability claims, claims that the Service fails to conform to legal requirements, or claims under consumer protection laws.
You agree to comply with all applicable third-party terms when using the Service.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms from time to time.
If we make material changes, we will notify you at least 14 days in advance. Continued use of the Service means acceptance of the updated Terms.
